Investment Amounts and TEAs


Standard investment amount: $1,050,000. TEA (Targeted Employment Area) investment amount: $800,000. These amounts were set by the EB-5 Reform and Integrity Act of 2022 (RIA 2022) and remain in effect for 2025. Urban High Unemployment Area (HUA) qualification requires federal verification of:

  • Rural areas outside metropolitan statistical areas

  • Urban areas with 150% national unemployment average


Job Creation Requirements


Each investment must create 10 permanent, full-time jobs for U.S. workers. Regional Center investments can count:

  • Direct jobs at the project

  • Indirect jobs through supply chain

  • Induced jobs from economic impact. Direct EB-5 projects can only count W-2 employees.


Source of Funds

Investment capital must be traced to lawful sources through:

  • Bank records

  • Tax returns

  • Business documentation

  • Investment statements. Cryptocurrency investments face enhanced scrutiny and documentation requirements.


Processing Times


I-526E Petition: typically 14-18 months for HUA set-aside projects (and as fast as under 7 months for our DOCS Surgical Hospital investors). Conditional Green Card: 2-year validity. I-829 Removal of Conditions: 18-24 months. Total timeline: typically 3-4 years to permanent residency for HUA projects.


Regional Center Updates


Under the RIA 2022, all regional centers must:

  • File annual I-924A statements

  • Submit to third-party fund administration audits

  • Maintain compliance fund deposits

  • Update project documentation quarterly


Due Diligence Requirements


Investors must verify:

  • Developer track record

  • Project feasibility

  • Market analysis

  • Job creation methodology

  • Exit strategy

  • Securities compliance (SEC Reg D)


Investment Maintenance

Capital must remain "at risk" through conditional residency. No guaranteed returns. Active business operation required. Material changes must be reported to USCIS.


Project Requirements

Business plan must be "Matter of Ho" compliant. Economic analysis must use accepted methodology. Proper securities registration/exemption required. Regular progress reports to investors.
